MEMORANDUM OF THE SOCIETY

1. NAME OF THE SOCIETY:- The name of the society shall be ‘
INDIAN CONFEDERATION OF INDIGENOUS & TRIBAL PEOPLES’

2. REGISTERED OFFICE:- The office of the society shall remain in the Sate of
Delhi and at present it is at the following address:-
C-9, 9555, Vasant Kunj
Delhi-110034.

3. AIMS AND OBJECTS:- The aims and objects for which the society is
established are as under:-

a. To develop, strength and ensure the unity, interlink and Solidarity of renovates/ organizations / institutions of all indigenous and tribal peoples in India without interfering with their autonomy.

b. To develop, strengthen, reserve and uphold the historical principles, philosophy concepts, traditions, languages, and literatures, or scripts and cultural various of the indigenous and tribal people’s groups organizations in India.

c. To develop, strengthen and economic exchange of information and view among the indigenous and tribal peoples in India and abroad and between the indigenous and tribal peoples and all other peoples in India.

d. To develop, strengthen and document to preserve, improve and strengthen and continuance of the technology of the indigenous and tribal peoples.

e. To develop, strengthen, and ensure the existence of the traditional social institutions, systems and organizations of all groups of indigenous and tribal people in various regions of Indian and to co-ordinate the common intonations of these organizations.

f. To develop, strengthen, and ensure action organized although research, documentation and programme of all India of and economic, political and cultural atrocities of denial of social justice of the indigenous and tribal peoples and to fight and campaign against them through peaceful democratic means, especially for the abolition of slavery genocide, ethnocide and for eviction from their traditional habitat.

g. To educate and campaign for the indigenous and tribal peoples’ rights of land, forest and natural resources including environment and their rights of self-determination in their affairs.

h. To combat racism, or communalism and to denounce any violation of human rights and fundamental liberties of human-kind;

i. To organize, associate, affiliate or to be affiliated with, co-operative and participate in the discussions, debates, seminars, conferences and campaigns of intellectual forms at the state, national and international levels in a mater which affect the indigenous and tribal peoples.

j. To provide training facilities for their social, educational, economic, cultural and administrative matters;

k. To publish or otherwise produce books, journals, papers and other written or recorded materials, translates, subscribe land and distribute books, pamphlets and treatises and cause transitions to be made into any language the books, pamphlets, etc. and to print, publish, subscribe and contribute the same in connection with the above matters.

l To take up issues and problems of the indigenous and tribal peoples and their other down-trodden neighbors with the Government of India and the State Government at various levels or departments, to propose proper legislation and amendments to find solutions and to co-operate in the solution and for such purposes to attain consultative status with the governments, for evolving national policies on such issues which affect the indigenous and tribal people especially.

m. To assist, provide information, equip with knowledge of facts etc. to the legislators in the Parliament and the State Legislatures for the constitutional rights and interests of the indigenous and tribal peoples.

n. To water, develop, strengthen and protect, the interests of all kinds of labour, farmers, students, women and children etc. belonging to indigenous and tribal peoples and to promote there are non-existent.

4. ANCLLARY OBJECTIVES:-

a. To obtain, borrow, raise, use disburse, channelise funds, resources, moveable and immovable property, goods, gifts, receipts from membership drive, donations, contributions, charitable foundations, government grants etc. from national and international course and to keep proper accounts for the same.

b. To invest and to operate with banks for transactions, fixed deposits, reserve funds, endowments and for all other necessary and miscellaneous purposes that may be required in such. Manner as the Government Body shall from time to time think fit.

c. To own, acquire, hire, purchase, receive or lease, give away on lease or to receive as gifts of goods property or land and to construct buildings of house sites, office training centers, liabilities, halls etc. and for allied purpose which develop and strengthen the work of the society.

d. To frame schemes, regulations or bye-laws and alter, modify or rescind the same.

e. To do all such things as may be incidental or conducive to the attainment of the objects of the society.

5. FINANCE:-

All the incomes, earnings, moveable, immoveable, properties of the society shall be solely utilized and applied towards the promotion of its aims and objects only as set forth in the memorandum of association and no profit on thereof shall be paid or transferred directly or indirectly or by way of dividends, bonus, profits or in any manner whatsoever to the present or past members of the society or to any person claiming through anyone or more of the present or the past members. No member of the society shall have any personal claim on any moveable or immovable properties of the society or make any profits whatsoever by virtue of this membership.

6. GOVERNING BODY:-

The names, address, occupation and designations of the present members of the governing body of the society to whom the management of the society is entrusted as required under section 2 of the societies registration act 1860, as applicable to the Union Territory of Delhi are as follows:-

RULES AND REGULATIONS OF THE SOCIETY

1. NAME OF THE SOCIETY:- The name of the society shall be
‘INDIAN CONFEDERATION OF INDIGENOUS & TRIBAL PEOPLES’

2. MEMBERSHIP:- The membership of the society is open to the indigenous and tribal peoples of India, collectively, who has attained the age of majority and abide by the rules and regulations of the society. Those institutions, organizations or federation or organizations of the indigenous and tribal peoples of Indian in various regions or states are eligible for membership of the society provided that their objectives are compatible with the aims and objects of the society. There are three types of membership in the society:-

A. Founder members:- All the desirous persons to form the society shall be the founder members of the society.

B. Organisational Members:- Grass-root organizations, professional, regional or state organizations will be regular members of the society after they are admitted by the governing by of the society and will pay an annual fee as the decided by the governing body. The admission of the organizational membership will de done initially by the Governing, Body and must be ratified by the General Body of the society. In the regional state in which a recognized member organization does not exist and which one is in the process of formation, the Governing Body will accept as an observer one or more indigenous and tribal representative for such regions or state.

C. PATRON:- There could be both national and international body of Patrons, both as individuals or as organizations or foundation, with genuine interest for the cause of the indigenous and tribal peoples and should be able to contribute substantially towards financial assistance for various activities of the society. The governing body will, however, examine all aspects of such patronage.

D. LIFE MEMBERS:- Any donor making a donation of Rs. 10,000/- or devoting their life along services to the society shall be the life members of the society.

E. ORDINARY MEMBERS:- With the approval of governing body any person may become an ordinary member of the society.

3. SUBSCRIPTION:- All fees will be determined by the General Body of the society from time to time and it is Rs. 100/- per month present.

4. REFUSAL:- The governing body of the society may refuse any person for the membership, provided reasons for refusal shall be communicated to the person concerned in writing with reason.

5. EXPULSION:- The governing body of the society may expel any member from the society on the following grounds:-

a. In his/her death.

b. If the member fails to pay the timely subscription continuously for three months from the due date of paying the subscription.

c. If the member works against the aims and objects of the society.

d. If the member tenders his/her resignation.

e. If the member fails to attend three meetings of general body continuously without intimation.

f. If he/she is adjudged by & competent court of law to be a criminal offender.

g. If he/she is adjudged by account court of law to be of unsound mind.

The reasons of expulsion shall be communicate to the concerned member. Every such expelled member should have a right to appeal before the general body which may or may not be accepted.

6. APPEALS:- All the appeals shall be preferred to the general body of the society, the decision shall be communicated to the member concerned. These clauses will be applicable as per mentioned in the termination clauses.

7. RE-ADMISSION:- In case of member expelled by the General Body the same can be readmitted provided the member concerned pays all up to date dues. The decision of the General Body shall be final. These clauses will be applicable for Para No. 5.

8. RIGHTS & PREVILEDGE OF MEMBERS:- The members will enjoy the following rights:-

a. To participate in the General Body of the society through representation of member organizations.

b. To vote on any matter concerning the society. Each member shall have one vote.

c. To ask for reports on the progress of any activity being performed by the society.

d. To be elected and to elect the members of the Governing Body.

e. To participate as members of the committee / committees that are established by the society from time to time for various functions.

f. To oversee the operation the strengthening of the society.

g. The organizational members shall have the right to attend the meetings of general body without the right to vote and without the right to stand for any election in the society.

9. GENERAL BODY:- There shall be a general body of the society consisting of all the members. The meetings of the general body shall be held after every one year with 1/3 quorum. No quorum shall be required in the adjourned meeting. An emergent meeting of the general body may also be summoned on the written request of 3/5 members, with ten days prior notice for such meetings. The notice period of general body shall be ten days. The following business shall be transected in these meetings:-

a. To discuss any matter in the society and its members organizations.

b. To approved the general guidelines of social economic, educational and cultural activities of the society.

c. To define or consider any work relationship of the society with other organizations and governmental and international agencies.

d. To establish society agencies or bodies experts or consultants/working groups as deemed necessary for effective performance of the society.

e. To ratify or annual the actions of the governing body and sanction appropriate reassures.

f. To discuss any matter or issue of indigenous and tribal people’s affairs of all India importance which the Governing Body would deem fit to put in the agenda.

g. To appoint a qualified auditor who will annually, audit the accounts of the society’s funds.

10. GOVERNING BODY:- There shall be a governing body of the society to look after and to manage the day today affairs of the society. It shall consist of minimum 9 and maximum 15 members including the office bearers. The meeting of the governing body shall be held after every two months with 1/3 quorum. Required in the adjourned meeting. An emergent meeting of the governing body may also be summoned on the written request of 3/5 members by 10-day notice of the meeting. The notice period of the governing body shall be 10 days. The following business shall be transacted in these meetings:-

a. To take necessary steps for the implementation of all the programmes and policies drawn by the General Body.

b. To pass the necessary expenditure to meet the day to day requirements of the society.

c. To take decisions on applications for membership.

d. To appoint committee for disposal of any business of the society or for advice in any matter pertaining to the society.

e. To arrange, finance if required from other bank (s), institution or individual on reasonable terms and conditions and the governing body as a whole is liable for its return.

f. To appoint, terminate and fix duties of any staff.

g. To receive, to have custody of and to expend the funds of the society and to manage the properties of the society.

h. To sue and defend all legal proceedings on behalf of the society.

i. To take all such other legal steps which may appear beneficial for the smooth and better management of society.

j. The following is the present structure of the governing body:-

i. Chief President ………….. One.

11. OFFICE BEARERS & THEIR DUTIES:-

i. CHIEF PRESIDENT:-

a. He/She shall preside over all the meetings of general body and governing body.

b. The Chief President shall, subject to the control and supervision of the executive committee, have the power providing general direction and management of the affairs of the society and shall preside over all meetings of the executive committee and general body.

c. At time of voice on any subject if he total votes of the groups of members happens to be equal in number, the chief president shall have the power caste an extra vote to decide the issue.

d. The Chief President shall have the power to allow inclusion of any subject in the agenda for discussion in the course of proceedings of meeting.

ii. SECRETARY GENERAL:-
The secretary general will be the custodian of the administrative setup of the society at the national level and he will co-ordinate the activities of the region and all other bodies. All the minutes, records and register will be under his custody, and will be the Chief spokes person of the society at the various levels within India and abroad.

a. He will make all correspondence with the respective authorities, with the government of India, state government and the international bodies and will report all facts at the meetings of the appropriate bodies of the society.
b. He will take the necessary initiative constitute the regional bodies with agreed and adopted proceedings and until such time that the organizations are formal and co-coordinated, he will take steps to initiate the formation of such member organizations. He will also initiate all activities for the programme or Polly implementation or for raising funds and resources for the society.

c. On the advice of the Chief President or the Governing Body he will convene all periodical, ordinary or extra ordinary meetings. Hw will also initiate all seminars, work shops, debates or conferences and other activities at the national level and also various study groups, research and documentation on various issues and programmes with which the society is concerned, and will arrange for their publications.

d. With the assistance of the appointed administrative staff and the Chief Treasurer of the society under his general supervision, he will keen accounts of all receipts and disbursements of funds of the society and will get such accounts audited by a charted accountant annually and submit a report there on the governing body.

e. On the advice of the Chief President and or approval of the Governing Body he will take care of all legal matters of court cases in which the society may be involved.

f. All the appointed staff will be under his direct supervision and administration. The Secretariat, under his guidance, shall do all activities entrusted to it by the Governing Body.

iii. CHIEF TREASURER:- All the assets and fu7nds of the society shall remain under the care of the Chief Treasurer. He shall make payments as per written authority of the society General and receive all payments on behalf of the society. The Chief Treasurer shall maintain the accounts of all moneys received or paid by him/her.

iv. EXECUTVE MEMBERS:- They shall assist in the day to day work of the society as directed by the Chief President and Secretary General.

12.A. ADVISORY BOARD:- There will be an advisory board consisting of 49 members, 7 members from each of the seven regions/zones. The Chairperson will be nominated of the Governing Body. The Board will meet at least twice a year and will recommend ways to improve function of the society.

B. REGIONAL & ZONAL BODIES:- Formation of the Regional/Zone bodies of the society will be on the basis of the memorandum of association and rules and regulations of the Central Body of the society outlined here. Their working relationship with the Central organization will be determined by mutual consultation.

C. PRIVILAGES AND FUNCTIONS OF MEMBER ORGANISATION:- Member organizations through their regional bodies of the society will have the right to have their representative at the general body and through elections in the Governing Body. Regional Bodies of the society will have the obligation to develop, strengthen and ensure the society’s organizations in different sub-regions where the indigenous and tribal people live. Regional bodies will co-ordinate with the sub-regional bodies in their representative goe-political areas in the same manner and procedure. They will adopt this memorandum as their guideline for their pattern of functioning.

D. They will present their policy directives to the Governing Body for information. The implementation of the directives and programmes will be the joint responsibility of the regional bodies in co-operation with the sub-regional bodies. The society of the Governing Body will co-operate in the manner that the so-operation is asked for.

13. FINANCIAL YEAR:- The financial year of the society shall be from 1st April to 31st March every year.

14. SOURCE OF INCOME AND UTILISATION:- Subscriptions, donations, grants in-aid and gifts and income from investments etc. shall be the source of income of the society. All the income of the society shall be utilized towards the aims and objects of the society.

15. BANK ACCOUNT OPERATION:- The funds of the society shall be kept in a scheduled bank. The bank account of the society shall be operated by the Chief Treasurer and any one of the Chief President or Secretary General.

15.A. AUDIT:- The accounts of the society shall be audited by the qualified auditor / chartered accountant every year.

16. FILLING UP CASUAL VACANCIES:- The casual vacancies may be filled up by the resolution of passed by majority of votes by both the governing body and general body up to the next election.

17. ELECTION:- The governing body of the society shall be elected for a term of three years in the general body meeting. The raising hands shall be the mode of election. The newly elected governing body list should be attested by three out going office bearers and it will be field with registrar of societies, Delhi.

18. ANNUAL LIST OF MANAGEMENT/GOVERNING BODY (Section 4 of Act):- Once in every year a list of the office-bearers and members of the governing body of the society shall be field with the registrar or societies, Delhi as required under section 4 of the societies registration act 1860.

19. LEGAL PROCEEDINGS (Section 6 of the Act):- The society may sue or be sued in the name of the Chief President/Secretary General as per provisions laid down under section 6 of the societies registration act 1860, as applicable to the Union Territory of Delhi.

20. AMENDMENT (Section 12 & 12.A. of the Act):- Any amendment in the Memorandum or rules will be carried out in accordance with procedure laid down under section 12 and 12-A of the societies registration act. 1860.

21. DISSOLUTION AND ADJUSTMENT OF AFFAIRS (Section 13 & 14 of Act):- If the society need to be dissolved, it shall be dissolved as per provision down under section 13 and 14 of the societies registration act 1860, as applicable to the Union Territory of Delhi.

22. APPLICATION OF THE ACT:- All the provisions under all the sections of the societies registration act 1860, a applicable to the Union Territory of Delhi shall apply to the society.

23. ESSENTIAL CERTIFICATE:- Certified that this is the correct copy of rules and regulations of the society.
